Terms of Use
Effective Date: August 25, 2026. These Terms govern your access to and use of zyFOCUS, including the web app, PWA, connected accounts, optional sync, AI features, music integrations, and related services and content. By using zyFOCUS, you agree to these Terms and the Privacy Policy.
1. Acceptance and Eligibility
You must be able to form a binding contract where you live to use zyFOCUS. If you are using the app on behalf of a business or organization, you confirm that you have authority to bind that entity to these Terms.
2. Account Types and Identity
Some features may require an account, including ZyMail sign-in or partner login. We may associate your profile with your primary address, device identity, or a partner identifier so we can authenticate you, sync your settings, and provide subscription access.
3. Local-First Product Model
zyFOCUS is designed to work locally first. Notes, preferences, downloads, and many app state changes may remain on your device unless you explicitly enable cloud sync, account-based backup, or another online feature.
4. Optional Online Services
Some features depend on third-party or partner services, including AI assistance, music playback, subscription verification, notifications, and sign-in. Those services may be unavailable, change over time, or require separate accounts or permissions.
5. Subscriptions and Paid Features
If you subscribe to a paid plan, we may unlock premium capabilities, higher limits, extra themes, or cosmetic items based on your active subscription status. Subscription status may be checked from our servers or from a partner service you connected.
6. License and App Use
We grant you a limited, non-exclusive, non-transferable license to use zyFOCUS for personal or internal business use, subject to these Terms. You may not copy, resell, reverse engineer, or interfere with the app except where law permits.
7. User Content and Ownership
You keep ownership of content you create or upload. You are responsible for making sure you have the rights to use that content. By uploading content, you give us the permissions needed to store, process, display, and sync it as part of the service you requested.
8. AI, Music, and Third-Party Data
When you use AI prompts, music playback, or partner integrations, your requests may be sent to third-party services to fulfill the feature. Those providers may process data under their own terms and privacy rules. You are responsible for reviewing those terms when you enable those features.
9. Security and Account Responsibility
You are responsible for protecting your login credentials, device access, and recovery methods. Tell us right away if you believe your account, token, or connected device has been compromised.
10. Acceptable Use
You may not use zyFOCUS to harm others, break the law, attempt unauthorized access, upload malware, scrape without permission, or abuse the service, rate limits, or partner APIs. We may limit or suspend access if we detect abuse or risk to the service.
11. Availability and Changes
We may update, change, remove, or pause features at any time. We do not promise uninterrupted availability, and maintenance, provider outages, or network issues may affect performance.
12. Termination
You may stop using the app at any time. We may suspend or terminate access if you materially violate these Terms, pose security or legal risk, or if continued access would harm the service or other users.
13. Disclaimers
zyFOCUS is provided on an as-is and as-available basis to the maximum extent allowed by law. We do not guarantee that every feature, integration, or partner service will always work or remain available.
14. Limitation of Liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or business opportunities arising from your use of the app.
15. Indemnity
You agree to indemnify and hold us harmless from claims arising out of your misuse of the app, your content, your violation of these Terms, or your violation of another person’s rights.
16. Changes to These Terms
We may update these Terms from time to time. If changes are material, we will update the effective date or provide another form of notice. Continued use after the update means you accept the revised Terms.
