1. Acceptance and Eligibility

By accessing or using zyFOCUS, you agree to these Terms. You must be legally able to form a contract in your jurisdiction to use the app. If you use zyFOCUS on behalf of an organization, you represent you have authority to bind that organization.

2. Definitions

"App" means zyFOCUS and its related services, features, and content. "You" means the user of the App. "Content" means any data, text, or material you add to the App (tasks, notes, events, or uploads).

3. Product Overview

zyFOCUS provides productivity tools such as tasks, notes, timers, calendar events, and notifications. The app is local-first: most data is stored on your device by default. Optional features may include premium tiers, store items, PWA capabilities, linked-device sync, friends sharing, online AI, and music streaming.

zyFOCUS is not a medical, legal, or financial service and does not provide professional advice. Any guidance or recommendations are for general informational purposes only.

4. Accounts, Linked Devices, and Device Identity

zyFOCUS may generate a local device identifier to support optional features such as premium tiers, friends, and linked-device sync. You are responsible for maintaining your device security. If you lose access to your device, local data may not be recoverable.

If you enable linked-device sync, you may link devices using a pairing flow. You can unlink a device at any time. Once unlinked, that device may be blocked from further sync until relinked.

5. License and App Use

We grant you a personal, non-exclusive, revocable license to use zyFOCUS for lawful purposes. You may not copy, modify, reverse engineer, or redistribute the app or its assets except as allowed by law.

6. Local Data and Backups

Your tasks, notes, calendar events, and settings are stored locally unless you export them or enable optional features. You are responsible for making backups using the Export tools. Data loss due to device failure, browser storage clearing, or forgotten passwords is your responsibility.

If you enable linked-device sync or sharing features, you are responsible for the data you choose to sync or share, and for maintaining access to your linked devices.

7. Encryption and Data Security

zyFOCUS provides encryption features to protect your data:

• Export and Transfer Encryption: When you choose encrypted export formats or QR code sharing, your data is encrypted using AES-256-GCM. You are responsible for safeguarding your transfer codes and passwords. Lost codes cannot be recovered by us.
• Locked Notes: Password-protected notes are encrypted locally. If you forget the password, the note content cannot be recovered.
• Local Storage Security: While we offer optional obfuscation for sensitive fields, local storage security depends on your device security. Physical access to your device may allow access to local data.

You acknowledge that encryption strength depends on your password choices. Weak passwords may compromise security. We cannot decrypt your data without your passwords or transfer codes.

8. Premium Features, Points, and Store

zyFOCUS may offer premium tiers (such as Pro or VIP), points, ZyPoints, and store items. These features are optional and may be unlocked via points, referrals, or promotional codes. Points and credits have no cash value and are not transferable.

Points are not currency and cannot be redeemed for cash. We may adjust, suspend, or remove points or store items if required by law, platform rules, or to prevent abuse.

9. Referrals and Rewards

Referral programs may be offered to earn points or access. We may limit, modify, or terminate referral benefits if we detect abuse, fraud, or misuse.

10. Push Notifications and Reminders

Push notifications are available in supported PWA installs and depend on your browser and device permissions. You are responsible for enabling or disabling notifications in the app and system settings.

11. Email Communications

We may send emails only for ban notices and reminders you explicitly request. If you choose to provide an email address, you consent to these limited communications. You can update your preferences in Settings where available.

12. Analytics and Product Signals

To improve stability, security, and product quality, zyFOCUS may collect usage analytics and technical signals when you enable analytics in the app. This may include event logs, device and browser metadata, and IP address. Analytics do not include the content of your tasks, notes, or calendar items by default.

13. Captcha and Security Checks

For security and abuse prevention, zyFOCUS may require captcha challenges (for example, Cloudflare Turnstile). By using the app, you agree to complete these checks when prompted. Captcha providers may process technical signals like IP address or device/browser data solely to detect abuse.

14. Sponsored Content and External Links

zyFOCUS may show sponsored cards or optional external offers to help keep the app running. These links open in a new tab and are provided by third parties. We don’t control or guarantee external sites or their content. If you choose to visit them, their terms and privacy policies apply. Points, trials, or rewards are only granted when the app explicitly says so.

You agree not to manipulate or artificially inflate ad interactions, offers, or referral activity. Suspected abuse may result in reduced rewards, suspension, or account restrictions.

15. Acceptable Use

• Do not misuse the app, attempt to exploit, or interfere with its operation.
• Do not attempt to access data you are not authorized to access.
• Do not use zyFOCUS for unlawful, harmful, or abusive activity.

16. Updates and Changes

We may update zyFOCUS or these Terms to improve features, security, or compliance. Continued use after changes indicates acceptance of the updated Terms.

17. Third-Party Services

Some features integrate with third-party services (for example: online AI providers, music catalogs, or push delivery). Use of those services is subject to their terms and privacy policies. We may disable or modify integrations to comply with platform rules or legal requirements.

Where the app uses ad networks or external offer providers, your interaction is governed by those providers’ policies. We aim to follow platform and network requirements, but we do not control their operations.

18. Intellectual Property

zyFOCUS, its branding, UI, and associated assets are owned by Zyservices or its licensors. You may not use our trademarks without permission.

19. Feedback

If you submit feedback or suggestions, you grant us the right to use them to improve the product without obligation.

20. User Content and Ownership

You retain ownership of your Content. You grant zyFOCUS a limited license to process your Content solely to provide the App features you use. We do not claim ownership of your tasks or notes.

You are responsible for ensuring your Content complies with applicable laws and does not infringe the rights of others.

21. Availability and Performance

We aim to keep zyFOCUS reliable, but we do not guarantee uninterrupted access, specific uptime, or that features will always be available. Performance may depend on your device, browser, and network conditions.

Some features may be restricted or unavailable in certain countries or regions to comply with local laws or platform rules.

22. Disclaimers

zyFOCUS is provided "as is" without warranties of any kind. We do not guarantee uninterrupted access or error-free operation. Productivity outcomes depend on user behavior and device performance.

23. Limitation of Liability

To the maximum extent permitted by law, Zyservices is not liable for indirect, incidental, or consequential damages arising from use of zyFOCUS, including data loss or productivity impacts.

24. Indemnification

You agree to indemnify and hold Zyservices harmless from claims or liabilities arising from your misuse of the App or violation of these Terms.

25. Termination

We may suspend or terminate access if you violate these Terms. You may stop using the app at any time by uninstalling or clearing local data.

25. Export Compliance

You agree to comply with applicable export control laws and regulations. You may not use the App where prohibited.

26. Governing Law

These Terms are governed by the laws applicable in your jurisdiction, subject to mandatory local consumer protections.
